Oz Hair and Beauty Pty Limited (ACN 137 915 809) trading as Oz Hair and Beauty, together with our subsidiaries and related bodies corporate (we, us or our), collects, stores, uses and discloses personal information in the course of carrying on our business, including operating our stores and salons, our website and apps, and providing our goods, services and loyalty program.

We are committed to protecting your personal information and to handling it in accordance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs). This Privacy Policy explains what personal information we collect, how we handle it, and how you can access it, correct it or make a complaint.

This Privacy Policy applies to personal information we collect through all of our channels, including our website (ozhairandbeauty.com), our mobile experiences, our physical stores and salons, our contact centre, social media, and our marketing and loyalty programs.

Personal information

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information or opinion is true and whether or not it is recorded in a material form.

Sensitive information is a subset of personal information (for example, information about your health) and attracts additional protections under the Privacy Act. We do not generally collect sensitive information. If we ever need to collect sensitive information, we will only do so with your consent or where we are otherwise permitted to by law.

Consistent with providing our goods, services and loyalty program, the types of personal information we may collect and hold include:

  • Identity and contact details — your full name, postal and delivery addresses, date of birth, telephone number, email address and other identifying and contact information.
  • Transaction and payment details — records of your purchases, orders, returns and refunds, and information connected to your payment. Card payments are processed by our third party payment providers; we do not store your full card details.
  • Account and loyalty data — if you create an account or join our Oz World loyalty program, your profile information, loyalty points and credit balances, tier status, preferences and purchase history.
  • Marketing and communication preferences — your subscription status and preferences for marketing, and the ways you engage with our communications.
  • Interactions with us — the content of your written and verbal communications with us, including where you post or comment on our platforms, contact us by live chat, phone, email or social media, and any feedback, reviews, survey responses or enquiries you provide.
  • Technical and usage data — information collected automatically when you use our website and apps, including your IP address, device and browser information, cookie and similar identifiers, pages viewed, links clicked, search history and other information about how you interact with us online.

You do not have to identify yourself, or you may use a pseudonym, when dealing with us where it is lawful and practicable to do so. In many cases, however, if you do not provide the personal information we ask for, we may not be able to provide our goods, services or loyalty program to you, or process your order.

How we collect personal information

We collect personal information in a number of ways, including:

  • directly from you — for example, when you make a purchase, create an account, join our loyalty program, subscribe to marketing, complete a survey, enter a competition, or contact us;
  • automatically as you use our website and apps, including through cookies and similar technologies (see Cookies and tracking technologies below); and
  • from third parties, such as our service providers, technology and marketing partners, payment providers, and social media and advertising platforms, where it is reasonable and practicable to do so.

The purposes for which we collect, hold, use and disclose personal information

We collect, hold, use and disclose personal information for purposes connected with our business, including to:

  • provide our goods and services and process, fulfil and deliver your orders, including returns and refunds;
  • operate your account and our Oz World loyalty program, including calculating and applying points, rewards and credits;
  • respond to your enquiries, requests and complaints and provide customer support;
  • where permitted by law, and where you have consented if consent is required, send you marketing communications and provide you with information, offers and advertising about our goods and services (and those of our partners) that may be of interest to you, including through targeted and personalised advertising;
  • personalise and improve your experience with us, and to operate, analyse, secure and improve our website, apps, services and platforms;
  • carry out internal administration, research, planning, analytics and product development;
  • detect, investigate and prevent fraud, misuse, security incidents and other unlawful activity, and to protect our customers, our business and our systems; and
  • comply with our legal obligations and to establish, exercise or defend legal claims.

We will not use or disclose your personal information for a secondary purpose unless that purpose is related to the primary purpose of collection and you would reasonably expect the use or disclosure, you have consented, or the use or disclosure is otherwise permitted or required by law.

How we disclose personal information

We may disclose personal information to:

  • our related bodies corporate;
  • our service providers and business partners who help us operate our business — including providers of e-commerce and website hosting, payment processing, order fulfilment and delivery, warehousing, IT and cloud services, customer support, reviews, analytics, and email and SMS marketing;
  • our technology and marketing partners, including advertising and social media platforms, for the purposes described in this Privacy Policy;
  • third parties in connection with an actual or proposed sale, merger or restructure of our business; and
  • law enforcement, regulators, courts and other government or third parties where required or authorised by law.

We require our service providers to handle personal information consistently with the Privacy Act and only for the purposes for which we engage them.

Direct marketing and how to opt out

Where permitted by law, we may use and disclose your personal information to send you marketing communications about our goods, services, offers and loyalty program by email, SMS, post, and through digital and social media advertising.

You can opt out of receiving marketing communications from us at any time by using the unsubscribe link in any of our marketing communications or contacting us at privacy@ozhairandbeauty.com. Once you opt out, we may still contact you with communications necessary to provide our goods and services to you (for example, order and delivery confirmations).

Cookies and tracking technologies

When you use our website and apps we, and our service providers and partners, use cookies, pixels, tags, software development kits and similar technologies to make our site work, remember your preferences, understand how our site is used, measure the performance of our marketing, and deliver personalised content and advertising.

Overseas disclosure

Some of the service providers and partners we use to operate our business are located, or store data, outside Australia, or use infrastructure located overseas. As a result, your personal information may be disclosed to, or accessible from, overseas recipients.

The countries in which these recipients are likely to be located include the United States, Canada, New Zealand and the countries in which our cloud, e-commerce, marketing and support providers operate their infrastructure.

Before disclosing personal information to an overseas recipient, we take reasonable steps in the circumstances to ensure that the recipient handles your personal information consistently with the Australian Privacy Principles.

Data security

We take reasonable steps to protect the personal information we hold from misuse, interference and loss, and from unauthorised access, modification and disclosure. These steps include technical, physical and organisational measures appropriate to the sensitivity of the information.

No method of transmission or storage is completely secure, and we cannot guarantee the absolute security of your personal information. If you have reason to believe that your interaction with us is no longer secure, please contact us immediately using the details below.

Notifiable data breaches

We are subject to the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act. If we become aware of a data breach, we will assess it promptly. Where a breach is likely to result in serious harm to any individual whose personal information is involved, and we have not been able to prevent that likely harm through remedial action, we will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.

Automated decision-making

We use technology to help us personalise your experience, tailor marketing, operate our loyalty program, and detect and prevent fraud and misuse. Where we use computer programs to make, or substantially assist in making, decisions that use your personal information and could significantly affect your rights or interests, we will provide information about that automated decision-making in accordance with the Privacy Act. Retention, access and correction

We retain personal information only for as long as it is needed for the purposes for which it was collected, to provide our goods and services, or to meet our legal, accounting or reporting obligations. When personal information is no longer needed, we take reasonable steps to destroy or de-identify it.

We take reasonable steps to ensure the personal information we collect, use and disclose is accurate, up to date and complete. If you believe personal information we hold about you is inaccurate, out of date or incomplete, you may ask us to correct it, and we will not charge you for making or actioning a correction request.

You may also ask us to provide you with access to the personal information we hold about you, and we will respond to your request within a reasonable period, and in most cases within 30 days. There is no charge for making an access request. We may charge a reasonable fee to cover the cost of giving you access (for example, for retrieving and copying information), and we will not charge you until you have confirmed you wish to proceed. In some circumstances we may be permitted by law to decline a request for access or correction, in which case we will explain why and how you can respond.

Government identifiers

We do not use or disclose government-related identifiers (such as a tax file number or driver licence number) as our own identifier of you, except where permitted or required by law.

Children

Our website and services are not directed at children. We do not knowingly collect personal information from children without the involvement of a parent or guardian. If you believe we have collected personal information from a child without appropriate consent, please contact us so we can address it.
